TestToeic.com is a free online TOEIC practice platform, with a paid VIP tier that unlocks advanced features.

Practice materials are provided for personal study only; please do not copy, bulk-crawl, or resell them.

VIP plans (one-time purchase or auto-renewing subscription) may auto-renew; you can cancel anytime and are eligible for a refund within 7 days under certain conditions.

"Seeds" are the platform's virtual currency used to pay for AI-graded features and cannot be converted to cash.

We do our best to provide a reliable service but cannot guarantee it is error-free; our liability is limited as described in Article 11.

TestToeic.com is not affiliated with, sponsored by, or endorsed by ETS, the owner of the TOEIC® trademark.

Article 1. Definitions

"TestToeic.com", "We", "Us", "the Platform": the online TOEIC practice service operated at testtoeic.com and related subdomains.
"User", "You": any individual who accesses or uses the Platform, whether or not they have registered an account.
"Service": all features, content, software and resources provided by TestToeic.com.
"VIP": a paid plan (one-time purchase or auto-renewing subscription) that unlocks advanced features.
"Seeds": an internal virtual currency used to pay for AI-based pronunciation/speaking scoring features (Dictation & Shadowing, Flashcard Shadowing, etc.), with no cash value.
"Our Content": the platform, software, source code, interface, design, logo and TestToeic.com trademarks.
"User Content": content created or submitted by a User to the Platform (public profile, feedback/bug reports with images, etc.).

Article 2. Acceptance of Terms

2.1. By accessing or using the Service, You confirm that You have read, understood, and agree to be bound by these Terms and our Privacy Policy, which forms an integral part of these Terms.

2.2. If You do not agree to any part of these Terms, please stop using the Service.

2.3. If You use the Service on behalf of an organization, You represent that You have the authority to bind that organization to these Terms.

Article 3. Description of Service

3.1. TestToeic.com (domain: testtoeic.com) is an online TOEIC practice platform providing services including but not limited to:

Full 7-part TOEIC Mock Tests modeled on the real exam format
Listening, Reading, Grammar and Vocabulary practice by section
Flashcard & Flashcard Shadowing
Dictation & Shadowing (listen-and-transcribe, speak-along with AI pronunciation scoring)
Speaking & Writing practice with AI scoring
Battle Mode: real-time practice duels against other users, Leaderboard & rank tiers
Friends & public profiles
TOEIC Score Converter tool & learning blog

3.2. TOEIC® is a registered trademark of Educational Testing Service (ETS). TestToeic.com is not affiliated with, sponsored by, partnered with, or endorsed by ETS in any way. Any reference to "TOEIC" is solely descriptive of the nature of the practice activity. Practice results on the Platform are not an official TOEIC score and do not guarantee actual exam results.

3.3. We may add, change, suspend or discontinue any feature of the Service at any time, with reasonable notice when a change significantly affects VIP Users.

Article 4. Eligibility & Account Registration

4.1. The Service is intended for individuals aged 16 or older. Users aged 16 to under 18 require the consent and supervision of a parent or legal guardian. Users under 16 may not use the Service.

4.2. To use the full features, Users must register an account with a valid email address and provide accurate, up-to-date information.

4.3. Each individual may register only one (1) account. Creating multiple accounts to abuse promotions, trials, or service limits may result in the suspension of related accounts.

4.4. Users are responsible for keeping their login credentials secure and for all activity under their account. Please notify Us immediately upon discovering unauthorized access. We are not liable for damages arising from Your failure to protect Your login credentials, except where caused by Our fault.

Article 5. Intellectual Property & License to Use

5.1. The platform, software, source code, interface, design, layout, logo and trademarks of TestToeic.com are owned by or lawfully licensed to Us and are protected by law.

5.2. Practice materials on the Platform are provided for personal, non-commercial study purposes. If You are a rights holder and believe certain content infringes Your rights, please contact [email protected] for prompt handling.

5.3. Subject to Your compliance with these Terms, We grant You a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial study purposes.

5.4. You may not (regardless of who owns the content): (a) copy, redistribute, publish, or resell content in any form; (b) mass-download content; (c) use the content/data to build a competing product or service; (d) remove copyright or trademark notices.

Article 6. User Content & Public Profile

6.1. When You update Your profile (display name, avatar, bio), submit feedback/bug reports (with images if any), or interact with the Friends/Battle Mode features, You retain ownership of that content.

6.2. You grant Us a worldwide, non-exclusive, royalty-free license to store, display and technically process User Content solely to operate and provide the Service (e.g. displaying your public profile, leaderboards). This license ends when You delete the content or Your account, except for what We must retain under legal obligations.

6.3. You may enable/disable your profile's public visibility in Your account settings at any time.

6.4. You represent that You have sufficient rights to Your User Content and that posting it does not infringe any third party's rights or the law. We may (but are not obligated to) moderate, hide or remove infringing User Content.

Article 7. Prohibited Conduct

7.1. Users may not engage in the following:

b	Reverse Engineering	Reverse-engineering source code, APIs, or protocols (except where mandatory law permits and cannot be waived)
c	Bypassing Authentication	Circumventing authentication mechanisms, forging tokens, or exploiting security vulnerabilities
d	Account Sharing	Letting others use your VIP account beyond the permitted device limit
e	Mass Download	Downloading large volumes of content (audio, questions, images)
f	Attacking the System	DDoS, injection, brute-force, or any other form of attack
g	Evading Limits	Using rotating proxies/VPNs to bypass rate limits or bans
h	Unauthorized Tools/Extensions	Building third-party tools that access the API without authorization
i	Battle Mode Cheating	Using multiple accounts, bots, or assistive software to manipulate match results or leaderboards

7.2. Consequences of violation (applied proportionally to the nature and severity): a warning and/or temporary suspension for a first minor violation; permanent account ban for repeat violations; immediate termination without refund for serious violations (mass crawling, reselling data, attacking the system); We reserve the right to seek damages and pursue other legal remedies.

7.3. We may apply technical measures to detect and prevent violations, including monitoring access behavior, device fingerprinting (hashed), rate limiting, and anti-bot measures. The scope and purpose of this processing is described in our Privacy Policy.

Article 8. Account Sharing & Device Limits

8.1. Each VIP account may be logged in on a maximum of two (2) devices simultaneously.

8.2. When a login exceeds this limit is detected, the oldest active session may be automatically logged out. If signs of account sharing are detected (multiple IPs from different regions, unusual fingerprints), We will warn the User.

8.3. Repeated violations after a warning may result in account action under Article 7.2.

Article 9. VIP, Seeds & Payment

9.1. VIP may be offered as a one-time purchase or a subscription (monthly/quarterly/yearly), priced as listed on the /pricing.html page. Prices include applicable taxes unless stated otherwise.

9.2. Seeds are an internal virtual currency used to pay for AI-based pronunciation/speaking scoring features. Seeds may be purchased directly or granted as part of a VIP plan; they cannot be converted to cash, cannot be transferred between accounts, and are non-refundable once used.

9.3. Payments are processed via partner payment gateways (e.g. PayPal). We do not store Your full credit/debit card information.

9.4. Subscription-based VIP plans automatically renew at the end of each billing cycle unless You cancel at least 24 hours before the renewal date. You may cancel at any time in Your account settings; cancellation takes effect at the end of the current cycle.

9.5. Prices may change. Price changes are notified at least 30 days in advance and only apply to the next billing cycle; You may cancel if You do not agree. If a renewal payment fails, We may suspend Your VIP access until payment is completed.

Article 10. Refunds & Right of Withdrawal

10.1. You may request a VIP refund within 7 days of payment, provided that: (a) You have used less than 20% of the VIP content; and (b) You have not violated these Terms. Seeds already purchased or used are not eligible for a refund (see Article 9.2).

10.2. Refund requests must be sent to [email protected] with Your registered email and transaction ID. Processing time: 5–10 business days after approval.

10.3. Refunds do not apply when: (a) the account was banned for violating Article 7; (b) more than 7 days have passed since payment; or (c) more than 20% of the VIP content has been used.

10.4. Statutory refund rights under applicable consumer protection law (where mandatory) are not limited by these Terms.

Article 11. Disclaimer of Warranties & Limitation of Liability

11.1. Disclaimer. To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) content is fully accurate or complete; or (c) practice results accurately reflect actual TOEIC exam scores.

11.2. Exclusion of damages. To the maximum extent permitted by law, We are not liable for indirect, incidental, special or consequential damages, including loss of profits, data, or opportunities, arising from or related to Your use (or inability to use) the Service.

11.3. Limitation of total liability. Our total aggregate liability to You shall not exceed the total amount You actually paid Us in the 12 months preceding the event giving rise to the claim.

11.4. Statutory limits. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Article 12. Indemnification

You agree to indemnify and hold TestToeic.com and Our team harmless from any claims, losses, and reasonable costs (including legal fees) arising from: (a) Your violation of these Terms or the law; (b) User Content You post; or (c) Your infringement of a third party's rights.

Article 13. Suspension & Termination

13.1. We may suspend or terminate Your access, with or without prior notice, when We have a reasonable basis to believe You have violated these Terms, pose a risk to the system or other Users, or as required by law.

13.2. You may stop using the Service at any time by ceasing access or deleting Your account via the /remove-account page.

13.3. Upon termination, the license granted under Article 5 immediately ends. Provisions that by their nature should survive (Intellectual Property, Disclaimer & Limitation of Liability, Indemnification, Governing Law & Dispute Resolution) remain in effect after termination.

Article 14. Force Majeure

We are not liable for delays or failures to perform due to events beyond Our reasonable control, including natural disasters, epidemics, war, disruption of electricity/Internet/third-party cloud infrastructure, large-scale cyberattacks, or changes in law.

Article 15. Changes to These Terms

15.1. We may amend these Terms. Material changes will be notified via Your registered email, a website banner, or an in-app notice.

15.2. Changes take effect 15 days after notice (or immediately for non-material changes or those required by law). Continued use of the Service after the effective date constitutes Your acceptance of the updated Terms.

Article 16. Governing Law & Dispute Resolution

16.1. These Terms are governed by and construed in accordance with the laws of Vietnam.

16.2. In the event of a dispute, both parties shall first attempt to resolve it through good-faith negotiation within 30 days of one party's written notice.

16.3. If no agreement is reached, the dispute shall be submitted to the competent People's Court of Vietnam for resolution.

Article 17. General Provisions

17.1. Severability. If any provision is held invalid by a competent authority, the remaining provisions remain in full force and effect.

17.2. No waiver. Our failure to enforce any right or provision does not constitute a waiver of that right.

17.3. Assignment. You may not assign Your rights/obligations under these Terms without Our prior written consent.

17.4. Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between You and Us regarding the Service.

17.5. Language. The Vietnamese version is the original and legally binding version. Translations into other languages are provided for reference only.
